Conditions of participation
(1) "Bocholt Wandert" (hereinafter referred to as the 'event') is organised by Wirtschaftsförderungs- und Stadtmarketing Gesellschaft Bocholt mbH & Co. KG (hereinafter referred to as the '"organiser"'). The company's registered office is as follows: Wirtschaftsförderungs- und Stadtmarketing Gesellschaft Bocholt mbH & Co. KG, Osterstraße 23, 46395 Bocholt.
(2) The sole contractual partner for all participants is Wirtschaftsförderungs- und Stadtmarketing Gesellschaft Bocholt mbH & Co. KG.
(3) A participant is a natural person taking part in Bocholt Wandert.
(4) An 'interested party' is a natural person who wishes to take part in 'Bocholt Wandert'.
§1 Scope
(1) These Terms and Conditions of Participation govern the legal relationship (organisational contract) established between a participant and the organiser.
(2) The organisational contract is concluded when the participant has purchased their participation ticket via the ticket website www.bocholt.de/bocholtwandert or from Tourist-Info Bocholt or Stadtmarketing Bocholt.
§2 Terms and Conditions of Participation and Participants' Health
(1) The organiser publishes the terms and conditions of participation on the website (www.bocholt.de/bocholtwandert.de) and invites only natural persons to take part who, in their own judgement, are in the physical and mental condition required to undertake such a sporting activity. It is also made clear that any participant may withdraw at any time and, where possible, should stay in groups whilst walking. We strongly advise against participation by anyone who is not in good physical condition or who has mental health issues. Every participant must possess a certain level of basic fitness and is responsible for their own safety and well-being.
(2) By registering with Bocholt Wandert, the participant confirms, on their own responsibility, that they meet the health requirements for participation. If necessary (in case of uncertainty), the participant should have their health checked and confirmed by a specialist doctor.
3) To take part in Bocholt Wandert, a natural person must have reached the age of 18 by the start of the event or must be accompanied by a parent or legal guardian whilst hiking.
A person who is under 18 years of age at the start of the event and is not accompanied by a parent or legal guardian may take part in Bocholt Wandert provided that the "Declaration of Consent for Participation by Minors up to the Age of 18 and Liability Waiver" has been signed by themselves and their legal guardian(s) and sent to the organiser in advance by email to schmitz(at)bocholt-stadtmarketing(dot)de. In addition to the declaration of consent, copies of the identity documents of the signing parent or guardian must also be submitted. Registration can only be made by email at schmitz(at)bocholt-stadtmarketing(dot)de and not via the online ticketing platform. The organiser recommends that participants under the age of 18 are accompanied by at least one parent or guardian.

(4) The registration fee for taking part in Bocholt Wandert is charged to cover the organisation of the route, the setting up of refreshment stations, the distribution of refreshments, the provision of first-aid staff at the refreshment stations, and the issuing of walking passes. It should also be noted that the Road Traffic Regulations (StVO) apply at every event.
§3 Rights of Personality and Data Protection
The City of Bocholt's Data Protection Regulation (www.bocholt.de) applies to the event.
§ 4 Disclaimer
(1) The organiser accepts no liability for any consequences arising from health risks to participants.
(2) The organiser accepts no liability for items belonging to participants and other spectators that are held in safekeeping free of charge.
(3) If the organiser is obliged, in cases of force majeure (e.g. official orders, severe weather, terrorist threats, fire) is obliged and entitled to alter or cancel the event, there shall be no entitlement to a refund of registration fees (tickets) and no claims for damages shall arise.
(4) The organiser shall not be liable for damage resulting from injury to life, limb or health.
(5) Participation is at the participant's own risk.
(6) By registering with Bocholt Wandert, the participant agrees that photographs and/or video recordings may be taken of participants during the event and may be used for subsequent publication and marketing purposes within the framework of Bocholt Wandert. In the case of children and young people under the age of 16, parental consent is also deemed to have been given upon registration of their child. Participants may withdraw their consent at any time. This may be done verbally on the day of the event or in writing to schmitz(at)bocholt-stadtmarketing(dot)de, referring to the relevant images.
§5 Limitation of Liability
(1) Participants' claims for damages or reimbursement of wasted expenditure are governed by the provisions of §4 of the Terms and Conditions of Participation.
§6 Cancellation
In accordance with § 312g of the German Civil Code (BGB), event bookings are excluded from exchange and return.
§7 Route
The organiser reserves the right to change the specified walking route at any time. Reasons for this may include regulatory requirements, weather conditions or opportunities for better planning. Any changes will be communicated by email or via the booking system.
§8 Exclusion from the event
The organiser reserves the right to exclude participants who do not behave responsibly from Bocholt Wandert before and during the event. Possible reasons for this may include: inadequate equipment, alcohol consumption, drug use, injuries, littering and endangering others.
German law applies.
The place of jurisdiction is Bocholt.
